1. Agreement to Terms

By accessing and purchasing services from DRVYN Fitness ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

2. Description of Services

DRVYN Fitness provides personalized online fitness coaching services, including but not limited to:

• Customized 16-week training programs
• Personalized nutrition guidance
• Weekly check-in and progress tracking systems
• Optional enhanced athlete protocol design and bloodwork analysis
• Ongoing support through our client portal

3. One-Time Payment Model

Our services are provided on a one-time payment basis of $500 USD. This payment grants you:

• Complete 16-week training program
• Complete nutrition blueprint
• Access to client portal for 16 weeks
• Weekly check-in system
• Progress tracking dashboard
• PDF download of your program

No recurring charges will be applied unless you explicitly purchase additional services.

4. User Responsibilities

4.1 Accuracy of Information

You agree to provide accurate, current, and complete information during the intake process, including health history, experience level, goals, and any medical conditions.

4.2 Medical Clearance

You acknowledge that:

• You are responsible for consulting with a physician before beginning any exercise program
• DRVYN Fitness does not provide medical advice
• You should seek immediate medical attention if you experience pain, discomfort, or any adverse symptoms during training

4.3 PED Use Acknowledgment

If you choose to use performance-enhancing drugs (PEDs):

• You acknowledge that PED use carries health risks
• You are responsible for ensuring any PED use is legal in your jurisdiction
• You will obtain regular bloodwork and medical supervision
• DRVYN Fitness provides educational information only, not medical prescriptions
• You release DRVYN Fitness from any liability related to PED use

5. Intellectual Property

All programs, content, and materials provided by DRVYN Fitness are protected by copyright and intellectual property laws. You agree to:

• Use materials for personal use only
• Not redistribute, resell, or share programs with others
• Not copy or reproduce content for commercial purposes

6. Disclaimer of Warranties

DRVYN Fitness provides coaching services "as is" without warranties of any kind, either express or implied. We do not guarantee specific results, as outcomes depend on individual effort, genetics, consistency, and numerous factors outside our control.

7. Limitation of Liability

To the maximum extent permitted by law, DRVYN Fitness shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use our services
• Any injury or health issues arising from following our programs
• Any use of performance-enhancing drugs
• Any unauthorized access to or use of our systems

8. No Refund Policy - All Sales Final

ALL SALES ARE FINAL. NO REFUNDS UNDER ANY CIRCUMSTANCES. Due to the digital and personalized nature of our services, we do not offer refunds, exchanges, or credits for any reason. By purchasing, you acknowledge and agree that all sales are final. See our No Refund Policy for complete details.

9. Privacy

Your use of DRVYN Fitness is also governed by our Privacy Policy.

10. Termination

We reserve the right to terminate or suspend your access to our services immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes by email. Your continued use of services after such modifications constitutes acceptance of the updated terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
